Supreme Court Upholds Bello’s Election As Kogi Governor

The Supreme Court of Nigeria on Tuesday dismissed all four appeals filed against the election of Mr Yahaya Bello as Kogi governor.

One of the appeals was filed by Mr James Faleke, former running mate to the deceased Mr Abubakar Audu who was governorship candidate of the All Progressives Congress (APC) until his death.

Audu’s death resulted in confusion and controversy as to his replacement owing to a lacuna in the Constitution and the Electoral Act which did not foresee a situation where a governorship candidate dies before the conclusion of the election.

Faleke argued that he was the rightful replacement and that votes cast for the APC belonged to he and Audu. The APC however nominated Bello who was the runner-up at its governorship primaries as replacement for Audu.

Yahaya Bello as APC candidate in the supplementary election defeated then incumbent Kogi governor, Mr Idris Wada, and was subsequently sworn in as governor.

Other appeals dismissed by the Supreme Court on Tuesday to uphold Bello’s election as Kogi governor were filed by former Governor Wada of the People’s Democratic Party (PDP), the Labour Party, and the Africa Democratic Congress (ADC).
