The Community Court of the Economic Community of West African States(ECOWAS) has ordered the release of Nigeria’s former National Security Adviser, Sambo Dasuki, declaring his arrest and continued detention ‘unlawful’ and a ‘violation of his right to liberty.’
According to Punch, the unanimous judgement, given by a three-man panel and read by Justice Friday Chijioke Nwoke, also awarded Dasuki N15m in damages, while stating that he be immediately released.
The former NSA had previously applied to the high court of the Federal Capital Territory and the federal high court, Abuja, to stop the EFCC from further prosecuting him, alleging that his re-arrest was a violation of court orders granting him bail. However, both courts dismissed the applications.
Now, the ECOWAS court has not only ordered his released and awarded him N15m in damages, it has also demanded the release of his properties confiscated by the state’s agents.
Punch adds that the court said the Nigerian State is unable to “substantiate its continued detention of Dasuki, also faulted the search of his houses in Abuja and Sokoto without valid search warrant.”
The fundamental rights enforcement suit was filed earlier this year by the former National Security Adviser.
