The Court of Appeal sitting in Makurdi, the Benue state capital has dismissed the appeal by Hon. Terhemen Tarzoor of the PDP against the Gov. Samuel Ortom of the APC saying it lacked merit.
Governor Samuel Ortom earlier won the case at the Tribunal but the PDP candidate, Hon. Terhemn Tarzoor Ph.D wasn't satisfied with the judgement and he proceeded to the Court of Appeal where he lost today again, he might be proceeding to the Supreme Court.

Tarzoor had on October 2nd 2015 filed a 14 ground appeal, complaining that the lower court erred in its judgement in holding that Ortom was duly elected having not been properly nominated by the All Progressives Congress, APC to contest the April 11th, 2015 governorship election in the State.
In his judgement Justice Mohammed Garuba dismissed Tarzoor’s appeal and upheld the judgement of the tribunal delivered on 29th September, 2015.
He said the appeal failed on all grounds, noting that rightly put, the evidence adduced by the first respondent appellant (Ortom) and second respondent appellant (APC) outweighs that of the appellant (Tarzoor).
“The burden rest on the petitioner who approaches a court to proof his petition. On the evaluation and examination of evidence, the tribunal did the proper and right thing. The Appeal fails on all the grounds and is thereby dismissed. We uphold that the judgement of the tribunal delivered on 29th September, 2015.
Reacting to the judgment, counsel to Tarzoor T.T. Hyundu said they will study it and decide on the next step to take.
While the State Commissioner for Justice and Attorney-General, Barr. Michael Gusah said the judgement is an affirmation of the overwhelming mandate given to the Governor by the people, adding that it would enable him concentrate fully on the governance of the State.
